General Terms and Conditions

1. Introduction and Scope

The terms govern access and use across all platform activities, including campaign creation, product purchases, and service access. Supplemental terms may apply to specific features.

2. Our Role

TeamFundraising operates as a B2B2C software platform. The company does not act as the merchant of record, does not fulfill or ship products, and maintains no responsibility for product transactions between Business Partners and Supporters.

3. User Types

  • Business Partners: Responsible for listings, pricing, inventory, taxes, fulfillment, shipping, returns, refunds, and chargebacks.
  • Fundraising Teams: Manage campaigns and ensure accurate information.
  • Supporters: Customer purchasers engaging directly with Business Partners.

4. Platform Use and License

Users receive a limited, non-exclusive, revocable license for intended purposes only. Prohibited activities include data scraping, security bypass, and identity misrepresentation.

5. Account Management

Users must provide accurate information, maintain credential confidentiality, and report unauthorized access immediately. Accounts may be suspended for violations or suspected fraud.

6. Intellectual Property

All platform content belongs to or is licensed to TeamFundraising. Users cannot copy, modify, or distribute without permission. Business Partners grant TeamFundraising non-exclusive rights to use trademarks within the platform.

7. Data and Privacy

Data processing follows the Privacy Policy. Business Partners access supporter data solely for transaction fulfillment. TeamFundraising retains ownership of platform data and may aggregate it anonymously for analytics and marketing.

8. Fundraiser Content Standards

Campaigns must be truthful, compliant with laws, and avoid impersonation or inappropriate material. Violations result in suspension or removal.

9. Payment and Transaction Terms

Transactions process through Stripe Connect. TeamFundraising disclaims responsibility for refunds, shipping delays, damaged products, and chargebacks. Supporters resolve issues directly with Business Partners. Business Partners accept full liability for such occurrences, including related Stripe or platform fees.

10. Fees and Taxes

Business Partners pay platform fees per their agreement. They bear sole responsibility for tax calculation and remission. Non-payment results in suspension or termination.

11. Platform Availability

The company aims for 24/7 uptime but provides no guarantee. We are not liable for damages resulting from downtime or interruptions.

12. Prohibited Conduct

Exploitation, malware, illegal use, intellectual property violations, and operational interference are forbidden. Violations trigger suspension or permanent bans.

13. Termination

TeamFundraising reserves discretionary termination rights for fraud, non-payment, or breach. Upon termination, remaining owed funds become immediately due.

14. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. All warranties, express or implied, are disclaimed.

15. Limitation of Liability

TeamFundraising disclaims liability for indirect, incidental, special, punitive, or consequential damages. Liability caps at amounts paid within twelve prior months.

16. Indemnification

Users indemnify TeamFundraising from claims arising from platform use, term violations, user content, and third-party disputes.

17. Legal Disputes

Terms are governed by State law. Exclusive venue is designated courts. Users consent to jurisdiction and waive forum objections.

18. Entire Agreement

These Terms, Privacy Policy, and service agreements constitute the complete agreement, superseding prior understandings.

19. Changes to Terms

Updates posted online become effective upon continued use.

Fundraising Policy

1. Fundraiser Setup

Only authorized individuals may create campaigns using accurate details. Verification documents may be requested.

2. Fundraiser Purpose and Conduct

Campaigns must reflect genuine fundraising needs and comply with applicable regulations. Misrepresentation results in suspension.

3. Payouts

Fundraising Teams receive shares calculated per Business Partner structure. Business Partners process payouts after fundraiser completion and verification. TeamFundraising plays no payout role.

4. Refunds, Returns, and Chargebacks

All requests go to Business Partners, who must disclose policies clearly. Business Partners cover chargeback-related fees. TeamFundraising may facilitate communication but doesn't enforce resolutions.

5. Tax and Legal Compliance

Business Partners ensure compliance independently. TeamFundraising provides no legal or tax advice.

6. Age and Consent

Members must be 13+. Those under 18 require parental consent. Unauthorized underage accounts are terminated.

7. Code of Conduct

Respectful, lawful interaction required. Harassment, hate speech, threats, spam, and fraud trigger immediate termination.

8. Platform Support

Technical issues contact TeamFundraising support. Product inquiries go to relevant Business Partners.

9. Policy Changes

Updates effective upon posting. Continued use implies acceptance.
